AERO BOWLING ARM WARRANTY
OUR WARRANTY IS NOT TRANSFERABLE: IF YOU SELL OR TRANSFER YOUR BOWLING ARM TO ANOTHER PERSON, PLEASE ADVISE THEM THAT THE BOWLING ARM MAY HAVE NO WARRANTY.
Definitions
1. In this warranty:
Accidental Damage means inadvertent damage to a Bowling Arm which is caused by an external factor not inherent in the normal use of the Bowling Arm, including dropping, impact, crushing, bending or similar physical damage.
Aero Bowls means Aero Bowls Pty Limited (ACN 152 377 878).
Bowling Arm means a bowling arm manufactured and supplied by Aero Bowls.
Inappropriate Storage Conditions means storage conditions which are likely to contribute to a Bowling Arm being damaged, including prolonged exposure to moisture, corrosive substances, excessive heat, or other conditions likely to damage its mechanical components.
Mechanical Defect means a defect in materials or workmanship inherent in the Bowling Arm which causes the Bowling Arm or one of its components to fail to operate as intended.
Misuse means use of a Bowling Arm other than for its intended purpose as a bowling aid, or use contrary to any operating or maintenance instructions supplied by Aero Bowls.
Normal Wear and Tear means gradual deterioration arising from normal use of the Bowling Arm and does not include premature failure caused by a Mechanical Defect.
Application of this warranty

1. This warranty applies to Bowling Arms supplied by Aero Bowls.
2. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
3. The benefits provided under this warranty are in addition to other rights and remedies which may be available by law in relation to the goods to which this warranty relates.
4. This warranty applies only to the extent permitted by law.
Warranty
5. Subject to clauses 8 and 9 below, Aero Bowls will repair a Bowling Arm which suffers a Mechanical Defect within 12 months of the date of purchase.
6. If Aero Bowls determines that a repair under clause 6 is not reasonably practicable, Aero Bowls may replace the affected component or the Bowling Arm with the same or an equivalent product. Nothing in this clause limits any right or remedy available under the Australian Consumer Law.
7. Whether damage or failure to a particular Bowling Arm is due to a Mechanical Defect will be determined by Aero Bowls, acting reasonably following inspection of the Bowling Arm.
8. To the extent permitted by law, clauses 6 and 7 above will not apply, and Aero Bowls will not repair or replace a Bowling Arm, where:
(a) The claimant is not the original purchaser of the Bowling Arm.
(b) The claimant cannot provide proof of purchase in respect of the Bowling Arm.
(c) The claim relates to damage which Aero Bowls determines is not a Mechanical Defect; or
(d) The alleged Mechanical Defect is determined by Aero Bowls, acting reasonably, to have been caused by one or more of:
(i) storage of the Bowling Arm in Inappropriate Storage Conditions;
(ii) Accidental Damage;
(iii) Misuse;
(iv) unauthorised alteration, modification, dismantling or repair;
(v) forcing, bending or overloading the levers, spring, adjustable sections, locking mechanisms or other moving parts beyond their intended range of operation;
(vi) Normal Wear and Tear; or
(vii) cosmetic scratching, scuffing, fading or marks which do not materially affect the operation of the Bowling Arm.
Conditions applying to warranty
9. Subject to clause 11 below, and to the extent permitted by law, claims made under this warranty will initially be made at the claimant's expense, including any costs associated with the freight of the Bowling Arm.
10. If a claim is successfully made under clause 6 or clause 7 of this warranty in respect of a Bowling Arm purchased less than 12 months ago, Aero Bowls will bear the reasonable standard cost of freight:
(a) of the Bowling Arm which is the subject of the claim to Aero Bowls; and
(b) of the repaired or replacement Bowling Arm or component to the claimant.
Making a claim under this warranty
11. To make a claim under this warranty, a customer must submit the following information to Aero Bowls:
(a) details and photographic or video evidence of the alleged Mechanical Defect, together with photographs showing the Bowling Arm and any model, serial number or other identifying information; and
(b) proof of purchase in respect of the Bowling Arm which is the subject of the claim. (Note the guarantee is not transferable so if you are not the original owner you cannot make a claim under this express warranty.)

13. If requested by Aero Bowls, a claimant must provide the Bowling Arm which is the subject of the claim to Aero Bowls for inspection by delivery of the Bowling Arm to 8A Lindsay Street Rockdale 2216 at their expense initially.
14. The claimant must provide Aero Bowls with any other information which Aero Bowls reasonably requests in respect of the Bowling Arm and/or the claim relating to the Bowling Arm.
15. Aero Bowls will not accept any claims under this warranty in respect of which clauses 12 to 15 above are not complied with.
16. If Aero Bowls determines that clause 6 of this warranty applies, it will repair the Bowling Arm or affected component. If Aero Bowls determines that repair is not reasonably practicable, clause 7 will apply. Subject to clause 11 above, Aero Bowls will bear any applicable freight costs for an accepted claim.
17. In the event that a replacement Bowling Arm or component is provided, Aero Bowls will not be required to return the defective component which is the subject of the claim to the claimant.
18. If Aero Bowls determines that this warranty does not apply to a claim and it is in possession of the Bowling Arm which is the subject of that claim, it will, at the claimant's option:
(a) return the Bowling Arm to the claimant at the claimant's expense; or
(b) where appropriate, provide a quotation for a chargeable repair before undertaking that repair.
19. Aero Bowls will be entitled to dispose of any Bowling Arm which remains in its possession in the circumstances outlined in clause 19 above after 60 days from the date on which it notifies the claimant of the result of the claim under this warranty.
20. Normal cosmetic wear, paint or finish chips, scratches, fading and similar appearance changes arising through ordinary use are not covered by this express warranty unless they are caused by a Mechanical Defect.
21. Keep the Bowling Arm reasonably clean and dry. Remove dirt or foreign material from moving and adjustable components and store the Bowling Arm in a dry place when not in use.
22. Do not force the operating levers, spring, adjustable sections or locking mechanisms beyond their intended range of movement. If a component becomes loose, damaged or difficult to operate, discontinue use where continued operation may cause further damage and contact Aero Bowls or an authorised dealer for advice.
23. Do not modify, drill, bend, dismantle or repair the Bowling Arm other than in accordance with Aero Bowls instructions or through an authorised repairer. Unauthorised modifications or repairs may affect coverage under this express warranty to the extent permitted by law.
