AERO BOWLS WARRANTY

OUR WARRANTY IS NOT TRANSFERABLE: IF YOU SELL YOUR SET TO ANOTHER BOWLER PLEASE ADVISE THEM THAT THE SET MAY HAVE NO WARRANTY.
Definitions 
1.    In this warranty: 

Accidental Damage means inadvertent damage to a Bowl which is caused by an external factor (that is, a factor which is not inherent in the Bowl), including use of the Bowl on a poorly maintained facility or the dropping of the Bowl on to a hard surface. 

Aero Bowls means Aero Bowls Pty Limited (ACN 152 377 878). 

Bowl means a bowl manufactured and supplied by Aero Bowls. 

Inappropriate Storage Conditions means storage conditions which are likely to contribute to a Bowl being damaged, including but not limited to: 
(a)    a combination of high temperatures and low humidity; and 
(b)    a combination of high temperatures and high altitudes. 
Examples of Inappropriate Storage Conditions include, but are not limited to: 
(a)    storage of Bowls in the boot of a car during high temperatures; and 
(b)    storage of Bowls in a sealed and heated house during winter. 

Misuse means use of a Bowl other than in accordance with standard bowling practices. 

Structural Defect means a structural defect inherent in the Bowl which causes cracking which penetrates the surface of a Bowl. 
Surface Cracking means cracking which does not significantly penetrate the surface of the Bowl or affect the performance of the Bowl. 
Thermal Cycling means exposure to high temperatures followed by rapid cooling, such as when a Bowl is left in direct sunlight and then placed in a cooler air-conditioned environment.

Application of this warranty 
1.    This warranty is provided by Aero Bowls:

2.    This warranty applies to Bowls supplied by Aero Bowls. 

3.    Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. 

4.    The benefits provided under this warranty are in addition to other rights and remedies which may be available by law in relation to the goods to which this warranty relates. 

5.    This warranty applies only to the extent permitted by law. 

Warranty 
6.    Subject to clauses 8 and 9 below, Aero Bowls will replace Bowls which suffer a Structural Defect within 10 years of the date of their manufacture. 

7.    Subject to clauses 8 and 9 below, Aero Bowls will replace Bowls which suffer Surface Cracking within 5 years of the date of their manufacture. 

8.    Whether damage to a particular Bowl is due to Surface Cracking and/or a Structural Defect will be determined by Aero Bowls in its sole discretion, acting reasonably. 

9.    To the extent permitted by law, clauses 6 and 7 above will not apply, and Aero Bowls will not replace a Bowl, where: 
(a)    The claimant is not the original purchaser of the Bowl. 
(b)    The claimant cannot provide proof of purchase in respect of the Bowl. 
(c)    The claim relates to damage which Aero Bowls determines is not a Structural Defect or Surface Cracking; or  
(d)    The alleged Structural Defect or Surface Cracking is determined by Aero Bowls, in its sole discretion but acting reasonably, to have been caused by one or more of: 
(i)    storage of the Bowl in Inappropriate Storage Conditions. 
(ii)    thermal shock as the result of repeated Thermal Cycling of the Bowls. 
(iii)    Accidental Damage; and/or 
(iv)    Misuse.  

Conditions applying to warranty 
10.    Subject to clause 11 below, and to the extent permitted by law, claims made under this warranty will be made at the claimant's expense, including any costs associated with the freight of Bowls. 

11.    If a claim is successfully made under clause 6 or clause 7 of this warranty in respect of a Bowl which was manufactured less than 12 months ago, Aero Bowls will bear the cost of freight: 
(a)    of the Bowl which is the subject of the claim to Aero Bowls; and 
(b)    of the replacement Bowl to the claimant.    

Making a claim under this warranty
12.    To make a claim under this warranty, a customer must submit the following information to Aero Bowls: 
(a)    details and photographic evidence of the Surface Cracking or Structural Defect, as well as photos of the front and back of the bowl showing the model, logo, colour, serial number and date stamp; and
(b)    proof of purchase in respect of the Bowl which is the subject of the claim. (Note the guarantee is not transferable so if you are not the original owner you cannot make a claim). 

13.    Information can be submitted to Aero Bowls to info@aerobowls.com

14.    If requested by Aero Bowls, a claimant must provide the Bowl which is the subject of the claim to Aero Bowls for inspection by delivery of the Bowl to 8A Lindsay Street Rockdale 2216 at their expense initially.

15.    The claimant must provide Aero Bowls with any other information which Aero Bowls reasonably requests in respect of the Bowl and/or the claim relating to the Bowl. 

16.    Aero Bowls will not accept any claims under this warranty in respect of which clauses 12 to 15 above are not complied with.   

17.    If Aero Bowls determines that clause 6 or clause 7 of this warranty apply, it will provide a replacement Bowl to the claimant. Subject to clause 11 above, the claimant will bear any costs associated with the freight of the replacement Bowl. 

18.    In the event that a replacement Bowl is provided, Aero Bowls will not return the Bowl which is the subject of the claim to the claimant. 

19.    If Aero Bowls determines that this warranty does not apply to a claim and it is in possession of the Bowl which is the subject of that claim, it will, at the claimant's option: 
(a)    dispose of the Bowl; or 
(b)    return the Bowl to the claimant at the claimant's expense.  

20.    Aero Bowls will be entitled to dispose of any Bowl which remains in its possession in the circumstances outlined in clause 19 above after 60 days from the date on which it notifies the claimant of the refusal of the claim under this warranty. 

21.    Paintwork, Chips, Scratches, Fading, Pitting (is caused by small stones on the green sticking to the bowl and that bowl hitting another bowl, dropping onto hard surfaces will cause damage, these are not covered by the warranty.

22.     Polish your set of bowls using a small amount of Monkey Grip. To remove the ring of dirt that forms around the bowl from wax and dust on artificial greens try washing up liquid and to get the shine back try furniture polish.  

23.    The Actuality Logo is Patented Process printed into the surface. Do NOT attempt to peel off or use any type of chemical to polish.

24.    The Solvent in Stickers (Club Stickers or others) – the solvent in some stickers glue may affect your paintwork and logos, thus, DO NOT LEAVE stickers on longer than the length of a game, use new stickers for each new game.
